1. Agreement and authority
By visiting eternalmemoryspace.com, contacting us, submitting materials, or purchasing a service, you agree to these Terms & Conditions and our Privacy Policy and Cookie Policy. You must be at least 18 years old, or act with the involvement and permission of a parent or legal guardian. If you arrange a memorial for a family, you represent that you have authority to provide the requested materials and instructions.
2. Our custom services
Eternal Memory Space, a service by JB Creative Studio LLC, provides custom Digital Memorials, QR Tribute Pages, Family Storytelling, and Legacy Preservation. We provide memorial space design, presentation, setup, and ongoing website and QR access services. This is a professional, custom-made service—not a self-service website platform or account where customers independently build and publish memorials.
A project may include a bespoke memorial film, written life story, photo gallery, family history section, hosted webpage, QR memorial bookmark, or related presentation. The final scope, schedule, deliverables, access level, price, and service term are controlled by the applicable written quote, order, or project confirmation.
3. Packages and included work
Our current package descriptions and starting project prices are:
- Package A — Individual Memorial: starting at US$260 for one loved one; one dedicated memorial space, one memorial film, one life story profile, up to eight displayed photos, one QR memorial bookmark, website setup and configuration, and two revision rounds before final approval. Annual website service is US$60 per year.
- Package B — Family Memorial: starting at US$460 for a memorial space for up to two family members; two memorial films, one life story profile for each person, up to eight displayed photos for each person, up to two QR memorial bookmarks, website setup and configuration, and two revision rounds before final approval. A second individual film or other work outside the confirmed scope may be added for an additional fee. Annual website service is US$90 per year.
- Package C — Family Legacy: starting at US$760 for a memorial space for up to four family members; up to four memorial films as confirmed for the project, a life story profile for each person, up to eight displayed photos for each person, up to four QR memorial bookmarks, a family history section, website setup and configuration, and two revision rounds before final approval. Annual website service is US$140 per year.
Package descriptions are starting points and may be refined in writing for a particular family. The confirmed project scope controls if it differs from this general list. Timelines depend on receiving complete source materials, approvals, and other information from you. We are not responsible for delays caused by missing, late, inaccurate, or unusable materials.
4. Family materials and permission to work
You and the family or other owner retain ownership and control of photographs, videos, audio, documents, stories, names, likenesses, and other materials you provide (“Family Materials”). JB Creative Studio LLC does not claim ownership of Family Materials. You give us a limited, nonexclusive permission to receive, copy, organize, edit, format, adapt, display, host, and maintain Family Materials only as reasonably needed to create and maintain the requested memorial and provide related support. This permission ends when the relevant service ends, except for limited records or backups retained as described in our Privacy Policy.
You represent that you own or have obtained the permissions, licenses, releases, and family authority needed for us to use Family Materials as instructed. You are responsible for the accuracy and lawfulness of supplied content and for identifying content that should not be shared. Do not submit confidential credentials, unlawful material, malware, or content that infringes another person’s rights.
5. JB Creative Studio LLC’s creative work
JB Creative Studio LLC retains ownership of its original website designs, memorial films, visual artwork, original writings, layouts, creative concepts, production methods, and other studio-created work, together with the proprietary Eternal Memory Space and Guiyun Hall branding, names, marks, and associated brand elements. This ownership does not change the family’s ownership of Family Materials incorporated into a deliverable.
After required project fees are paid, we grant the customer and intended family recipients a limited, nonexclusive, nontransferable right to access and use the completed memorial for personal, family, and memorial purposes during the applicable service term. No original work may be copied, reproduced, modified, translated, imitated, resold, publicly distributed, sublicensed, or used commercially without our prior written permission. We will not use Family Materials or a family’s memorial as a marketing example without appropriate written permission.
6. Review and revisions
Each Package A, B, and C project includes two rounds of reasonable revisions before final approval. A revision round means one consolidated set of requested changes after a review version is provided. Additional revisions start at US$25 per round. Additional photos, a new or replacement film, newly added content, a new creative direction, major content changes, or other work outside the confirmed scope may require an additional fee. We will communicate the additional cost and obtain your approval before extra work begins.
Customers are responsible for carefully reviewing and confirming all names, dates, photographs, captions, life stories, family history, links, access settings, and QR destinations before final approval. We are not responsible for errors that remain in materials or are approved by the customer.
7. Additional services
Subject to availability and a separate quote or approval, additional services may include:
- Additional Memorial Film — starting at US$150.
- Additional Photo Gallery — starting at US$50.
- Additional Memorial Member — pricing upon request.
- Additional QR Code Memorial Bookmark — pricing upon request.
- Optional Buddhist Memorial Blessing Ceremony — pricing upon request.
- Major content changes or other custom work — pricing upon request.
8. Payment, production, cancellation, and refunds
Unless a written project agreement says otherwise, a 50% deposit is due before work begins. The remaining 50% balance is due after final approval and before the memorial space is published. Prices are in U.S. dollars.
Production generally takes 2–4 weeks after the deposit and all required photos, information, and materials have been received. More complex projects or delayed reviews may require additional time. Because each memorial space is custom-made, the deposit becomes nonrefundable once production has begun. Any cancellation before production begins, refund, or amount due for work already performed will be handled under the applicable written agreement and applicable law.
9. Annual website and QR service
An annual service fee is required to keep the memorial website active and accessible through its QR code. The current annual fees are US$60 for Package A, US$90 for Package B, and US$140 for Package C. This service supports continued website hosting, maintenance, and QR access and is separate from the initial custom production price unless the written project agreement says otherwise.
If annual service is not renewed or a service is canceled, we may take the memorial offline after notice is provided. You may contact us about a requested copy, download, or continued preservation, subject to the project agreement and any applicable fee.
10. Publication, later changes, and QR access
Once the customer gives final approval and the memorial is published, additional changes may require an additional service fee. A QR code is a convenience link, not a guarantee of identity, confidentiality, or uninterrupted access. Anyone who possesses a QR bookmark or URL may be able to reach the linked page. Please share access carefully and notify us if a destination should be changed, restricted, replaced, or taken down.
11. Acceptable use
You may use the website and your memorial only for lawful, personal, family, and service-related purposes. You may not access another family’s memorial without permission; interfere with the service; probe or bypass security; scrape or copy the site or studio materials; upload malicious code; impersonate another person; or use the service to harass, defame, threaten, exploit, or infringe the rights of others. We may remove content or suspend access when reasonably necessary to protect people, the service, or our legal rights.
12. Availability and third-party services
We aim to keep memorial pages and QR destinations available, but hosting outages, maintenance, internet failures, security events, force majeure events, and changes or failures in third-party services may interrupt access. Email, hosting, media playback, payment arrangements, and other functions may depend on third parties whose terms and policies also apply. We do not guarantee that every device, browser, QR scanner, or media player will support every feature.
13. Disclaimers and limitation of liability
To the fullest extent permitted by law, the website and services are provided on an “as available” and “as is” basis. JB Creative Studio LLC disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. We do not provide legal, tax, estate-planning, medical, or mental-health advice, and we do not guarantee a particular emotional, family, cultural, spiritual, business, or preservation outcome.
To the fullest extent permitted by law, JB Creative Studio LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or access, arising from or related to the website or services. Our total aggregate liability for a claim will not exceed the amount you paid to JB Creative Studio LLC for the affected service during the 12 months before the event giving rise to the claim, or US$100 if no payment was made. Nothing in these terms limits liability that cannot legally be limited or waived under applicable law.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless JB Creative Studio LLC and its owners, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your Family Materials, your breach of these terms, your misuse of the service, or your violation of another person’s rights.
15. Suspension, termination, and changes
We may suspend or terminate access for nonpayment, misuse, security risk, legal requirement, or a material breach. Sections concerning ownership, permissions, payment obligations, disclaimers, liability limits, indemnification, dispute resolution, and any terms that by their nature should survive will continue after termination. We may update these terms as the service changes; the date above identifies the current version.
16. Governing law and contact
These terms are governed by the laws applicable to JB Creative Studio LLC’s principal place of business, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Any dispute will be handled in a court or forum with appropriate jurisdiction, unless the parties agree to another lawful resolution. Before starting a formal claim, please contact us so we can try to resolve the concern thoughtfully.
